1. Introduction

NyxCollective LLC ("Company", "we", "us", "our") operates NyxPrism™ (the "Software"). This Privacy Policy describes how we handle information in connection with the Software and our website at nyxprism.com.

We are committed to minimising data collection and protecting your privacy. This policy is designed to be clear and plain rather than legalistic.

2. Information We Do Not Collect

The following categories of data are not collected by NyxCollective LLC:

• The contents of any PDF files you process
• Text extracted from your documents via OCR or the text layer
• AI summaries, classifications, or extracted key information
• File names or directory structures on your machine
• Usage telemetry or analytics about which commands you run
• Crash reports or error logs (unless you manually submit them)

3. Local Processing

All core PDF operations — split, merge, compress, rotate, watermark, protect, unlock, OCR, image conversion, and heuristic AI analysis — are executed entirely on your local machine using the libraries installed with the package. No network connection is required or initiated for these operations.

The --strategy heuristic AI mode also runs entirely locally. It uses pattern-matching and rule-based analysis without any external API calls.

4. OpenAI API Integration

NyxPrism™ optionally integrates with the OpenAI API. This feature is activated only when you:

• Set the OPENAI_API_KEY environment variable to a valid key, and
• Use a command with --strategy llm or --strategy auto (when auto-strategy selects LLM)

When this integration is active, extracted text from the relevant pages of your PDF is sent directly from your machine to the OpenAI API endpoint (api.openai.com) using your API key. This transmission:

• Is initiated by your own machine, not by any NyxCollective LLC server
• Uses your personal OpenAI account and API key
• Is governed by OpenAI's Privacy Policy

NyxCollective LLC does not act as an intermediary for this data transmission and does not receive, store, or process any data sent to OpenAI. You are solely responsible for your compliance with OpenAI's terms when using this integration.

5. Website Hosting

Our website (nyxprism.com) is hosted on Vercel. When you visit our website, Vercel may collect standard server log data (IP address, browser type, referring page, etc.) in accordance with Vercel's Privacy Policy. NyxCollective LLC does not have access to raw server log data.

We do not use any first-party analytics, tracking pixels, or advertising cookies on our website. We do not use Google Analytics or any similar service.

Our website uses Google Fonts, which are loaded from Google's servers. Google may log requests in accordance with their privacy policy. Fonts are used solely for visual presentation.

6. Account Data (Professional and Enterprise Tiers)

If you create an account for a paid subscription, we will collect and store:

• Your name and email address
• Billing information (processed and stored by our payment processor; we do not store card numbers)
• Account preferences and subscription status

This data is used solely to manage your subscription, provide support, and communicate service updates. We do not sell, rent, or share this data with third parties for marketing purposes.

Note: The account system is currently in development. This section will be updated when account services launch.

7. Cookies

The NyxPrism™ software itself does not use cookies. Our website may set a session cookie if you log in to an account, solely to maintain your authenticated session. No tracking or advertising cookies are set.

8. Children's Privacy

NyxPrism™ is not directed at children under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us immediately.

9. Data Security

Because we do not collect or store your document content, the attack surface for your most sensitive data is limited to your own machine and, where applicable, your OpenAI account. We encourage you to:

• Store your OpenAI API key securely (environment variable or secrets manager, not in source code)
• Keep NyxPrism™ updated to benefit from dependency security patches
• Use the protect command to encrypt sensitive PDFs at rest

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Effective" date at the top of this page. For material changes that affect how we handle account data, we will notify paid subscribers via email.
